1. These terms and conditions are an agreement between client(s) and trainer. Payments will be taken for the trainer providing one-on-one regular coaching agreements, creation of training plans, nutrition plans, supplementation plans, in-person personal training sessions and/or athlete stage posing training sessions.
2. All payments for services must be made in advance using the previously agreed payment method (via website or personally agreed).
3. If payment is not made in advance or at the start of service provision then the booked session may be cancelled and subject to charge (unless the trainer is notified in advance).
4. All sessions must be booked within reasonable notice (usually 24 hours prior). This gives time to arrange time slots. Individual agreements are possible depending on the case.
5. Clients that have agreed time/regular slots do not need to give prior notice for sessions unless any changes are being made to the day/time of the planned session(s).
6. If clients are unable to attend sessions then the trainer must be notified in advance (this is typically 24 hours in advance). If clients are unable to attend sessions and the trainer is not given reasonable notice then the cost of the session will be charged in full. (see exceptions under 9.)
7. Price and included services are all to be discussed and agreed before any service is provided.
8. If any clients are unable to attend a training session and payment has been made in advance then sessions that have not yet been taken may be held until further notice and can be rescheduled. This is providing any sessions have not been cancelled at short notice (they will be charged at full price as mentioned in 6). Sessions may be held for a maximum of 8 weeks. This allows time for clients to have time away if needed or for recovery/vacation etc. After the 8 week period the remaining sessions cannot be guaranteed.
9. If clients are unable to continue training due to reasons of a serious nature such as a serious medical/personal issue or bereavement of a close family member then the cost for any remaining sessions will be refunded in full via the original payment method.
10. If for any reason the trainer is unable to continue with the coaching or if DreamChaXer Training & Nutrition ceases operation then the cost for any remaining sessions will be refunded in full via the original payment method. This does not apply if the reason for discontinuing the coaching lies in a repeated violation of common decency or good morals by the client, such as e.g. non-compliance with agreed payments, harassment of the coach of any kind, sharing of confidential information, damage to the company’s/coach’s reputation, etc. Depending on the severity of such incidents the provision of services may be cancelled immediately or (in less severe cases) after the second occurrence with one prior warning issued by the coach. In this case no refunds will be granted.
11. Fees for regular full service coaching have to be paid each month in advance for the full month at the time of subscribing to the service. The billing interval is monthly and the coaching fee will be due each month on the same calendar day on which the subscription was first made (example: subscription on 11th May, next billing interval on 11th June, 11th July, etc.) Should the client cancel the collaboration before completing at least one full month, the client has no right of reimbursement, as the minimum subscription duration is 1 month. This is to avoid the misuse of the coaching offer as a cheaper way to receive plans and programmes and then drop out immediately. It ensures that the work invested by the coach will be compensated either way.
12. The full service coaching subscription is agreed for an indefinite period of time unless agreed otherwise individually. If the coaching is not cancelled explicitly (cancellation, see 13), coach and client(s) commit to continuing the provision of services respectively paying the agreed monthly charges every month.
13. As stated in 12., The full service coaching subscription, once started, renews itself automatically month by month if not previously otherwise agreed. If the client wants to cancel the coaching agreement, they have to notify the coach or manage the subscription via the customer portal provided by the webshop. The subscription ends immediately with the date of cancellation, but there will be no partial refund if the cancellation takes place amidst an already running billing cycle. Exceptions subject to individual agreement.
14. Coach and client(s) commit to base their relationship entirely on common decency and good morality. In case of failure to comply with these, collaborations may be cancelled (as stated in 10.)
